Land titles in Abuja explained: C of O, R of O and allocation papers

What a C of O, R of O, Area Council allocation and deed of assignment mean in Abuja, how they differ from Lagos titles, and which one you should insist on.

Key takeaways

  • In Abuja, land is held under the Land Use Act and administered for the FCT Minister through the FCDA and AGIS.
  • A Certificate of Occupancy (C of O) is the strongest common title. A Right of Occupancy (R of O) is the offer that comes before it.
  • Area Council allocation papers must be regularised with AGIS before you rely on them.
  • When land changes hands, a deed of assignment with the Minister's consent completes the transfer.

Land documents in Nigeria come with a lot of abbreviations, and sellers know it. This guide explains, in plain words, the titles you will meet when buying in Abuja, what each one proves, and the questions to ask before you pay.

Who owns land in Abuja?

Under the Land Use Act of 1978, land in Nigeria is held in trust by government and granted to people and companies as a right of occupancy. In the Federal Capital Territory, that power sits with the FCT Minister, working through the Federal Capital Development Authority (FCDA) and its land registry, AGIS. Every genuine title in Abuja should therefore trace back to an FCT record.

Certificate of Occupancy (C of O)

A C of O is the document that confirms a statutory right of occupancy over a specific plot, for a fixed term and on stated conditions. It is the title most buyers and banks look for, because it sits at the end of the official process and is recorded at AGIS.

Right of Occupancy (R of O)

An R of O is the offer of a right of occupancy. It sets out the terms and the bills to be paid. Once those are paid and the process is completed, the holder can obtain the C of O. An R of O is a genuine government document, but it is a step before the finished title, so ask how far the C of O process has gone.

Area Council allocations

Abuja's six Area Councils (including AMAC, Bwari and Kuje) have historically issued allocations, often for land in the outer districts. These papers must be regularised with AGIS to be recognised in the FCT land system. If you are offered land on Area Council papers alone, ask for proof of regularisation and have your lawyer confirm it.

Deed of assignment and Minister's consent

When land that already has a title is sold, the seller assigns their interest to the buyer with a deed of assignment. In the FCT, the Minister's consent is needed for that transfer, and it should then be registered at AGIS. Until that happens, the old holder still appears on the record.

Buying in an estate

In an estate, the developer usually holds the title to the whole estate land and allocates individual plots to buyers. Ask two questions: what title covers the estate land, and what document will you receive for your plot (an allocation letter, a sub-lease or a deed). Every Apase listing names the estate's title and approving authority, for example our Empire City estate guide.

How this differs from Lagos

In Lagos the Governor, not the FCT Minister, grants titles, and you will meet other terms: Governor's consent for transfers, and excision or gazette for land released from government acquisition to a community. If you are buying in Lekki or Ibeju-Lekki, ask your lawyer for a Lagos land registry search instead of an AGIS one.

Frequently asked questions

Is an R of O as good as a C of O?

An R of O is a genuine government document, but it is the offer stage. A C of O is the completed title. If you are buying land with an R of O, ask how far the C of O process has gone and what is left to pay.

Are Area Council papers valid in Abuja?

They must be regularised with AGIS to be recognised in the FCT land system. Ask for proof of regularisation and have a lawyer check it.

What is Governor's consent?

In Lagos and other states, Governor's consent is the approval needed to transfer land that already has a title. In Abuja, the equivalent approval comes from the FCT Minister.
